How National Origin Discrimination Appears in the Workplace

Discrimination based on national origin rarely arrives with an explicit statement. More often, it shows up in patterns: a qualified candidate with a foreign-sounding surname repeatedly screened out at the resume stage, an employee from a particular background held to stricter performance standards than colleagues, or a worker assigned less desirable shifts after raising a concern about biased comments.

Harassment is another recognized form. Ethnic slurs, mockery of accents or cultural practices, and deliberate exclusion from workplace activities based on national origin can each create a hostile work environment, which is actionable under FEHA when the conduct is severe or pervasive enough to alter the conditions of employment. FEHA also prohibits retaliation against any employee who reports national origin discrimination, participates in an investigation, or otherwise asserts their rights under the law.

California employees generally have three years from the date of a discriminatory act to file an administrative complaint with the California Civil Rights Department (CRD). Once the CRD issues a right-to-sue notice, you typically have one year to file a civil lawsuit in Superior Court. Missing either deadline can affect your claim, so timing matters.
